Terms & Conditions

These Terms & Conditions (“Terms”) are a legal agreement between you and Catch'Um Games(“Catch'Um”, “we”, “us”). They govern your access to https://www.catchum.appand the Catch'Um mobile application (the “App”).

By using our website or downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use our services.

You must be old enough to consent to these Terms in your country (at least 13, or 16 in some jurisdictions). If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms on your behalf.

You may not use Catch'Um where doing so would violate local law, park rules, or wildlife protection regulations.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the App on Apple-branded devices you own or control, solely for personal, non-commercial use, in accordance with these Terms and Apple's App Store terms.

You may not:

• Copy, modify, reverse engineer, or create derivative works of the App except as permitted by law.
• Use bots, scrapers, or automated tools to access the website or App in ways that burden our systems.
• Circumvent security, rarity, or collection mechanics.
• Use Catch'Um to harass wildlife, trespass, or break any law or site rule.
• Upload unlawful, harmful, or misleading content through the App.

Catch'Um encourages responsible wildlife watching. You are solely responsible for your conduct outdoors.

• Keep a safe, legal distance from animals. Never feed, touch, or disturb wildlife to obtain a scan.
• Follow all local laws, park regulations, and conservation guidance.
• Do not enter restricted areas or put yourself or others at risk for a discovery.
• Species identification in the App is for entertainment and education; do not rely on it for safety-critical decisions (e.g. distinguishing venomous species).

Some features require an account. You are responsible for activity on your account and for keeping your credentials secure. Notify us promptly at hello@catchum.app if you suspect unauthorised access.

You retain ownership of photos and content you submit, but you grant us a worldwide, royalty-free licence to host, process, display, and use that content to operate and improve Catch'Um (for example, to identify species and show your collection). We may remove content that violates these Terms.

Catch'Um may offer free and paid features. Any in-app purchases are processed by Apple. Refunds are handled under Apple's policies. Prices and features may change with notice where required.

Wildlife guides and field notes on catchum.app are provided for general information. If you sign up for launch notifications, you agree we may email you about the App Store release. You can opt out by replying to that email or contacting us.

Catch'Um, our logos, app design, species artwork, and website content are owned by Catch'Um Games or our licensors and protected by copyright and other laws. These Terms do not grant you any rights to our trademarks or brand assets.

THE APP AND WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee uninterrupted service, perfect species identification, or that discoveries will sync in all network conditions. Use your judgment in the field.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CATCH'UM GAMES AND ITS DIRECTORS, EMPLOYEES, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF CATCH'UM.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP OR WEBSITE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) GBP £50.

Nothing in these Terms limits liability that cannot be limited under applicable law (including death or personal injury caused by negligence where such limitation is prohibited).

You may stop using Catch'Um at any time and delete the App. We may suspend or terminate access if you breach these Terms or if we discontinue the service. Sections that by nature should survive (licence restrictions, disclaimers, liability limits, and governing law) will survive termination.

If you downloaded the App from Apple's App Store, the following also applies:

• These Terms are between you and Catch'Um Games only, not Apple. Catch'Um Games is solely responsible for the App and its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to an applicable warranty, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Apple's standard App Store terms also apply to your use of the App.

Governing law

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction, except where mandatory consumer protection laws in your country give you the right to bring claims locally.

Changes

We may update these Terms. We will post the revised version on this page and update the effective date. Continued use after changes constitutes acceptance. For material App changes, we may also notify you in-app.
